Intervention orders

What is an intervention order?

An intervention order is intended for situations where an adult needs a one-off decision made or someone to take an action. If the adult would require ongoing support in relation to financial or welfare issues then a guardianship order, incorporating a request for a specific power to sell or acquire a property, may be more appropriate.

How can it help with homeownership?

Intervention orders will most commonly be suitable for financial and property matters, but they could also be suitable for some personal welfare matters. Where an intervention order covers the acquisition or disposal of a house the consent of the Public Guardian is required for the price paid or obtained.

Who can apply for one?

Anyone claiming to have an interest in the property, financial affairs or personal welfare of the adult can make an application to a Sheriff Court. This person could be a private individual, such as a friend or relative, or a professional such as a solicitor, accountant, banker or someone from a voluntary organisation.

What needs to be proved?

The sheriff would have to be satisfied that the adult is incapable with regard to the matter in question, and that there is no other suitable means of dealing with the matter.
